Terms of Service

1. Scope

These Terms of Service govern the use of the MyMindSeed platform and all purchases on it. The provider and your contractual partner is:

2. Description of Services

On MyMindSeed you tell an AI about your life. This creates your “Mindseed” – an AI conversation partner that keeps what you approve and grows your life tree from it. The platform offers:

• Creating and maintaining your Mindseed with memories, biography and traits
• Chatting with your Mindseed (text, optionally with voice input and voice output)
• Optional: a cloned voice for your Mindseed
• Optional: sharing your Mindseed by link or in the gallery for signed-in users so that others can talk to it
• Optional: bridge messages between users via their Mindseeds
• Optional: AI images in chat
• A token system used to pay for paid features (Section 4)

2a. Operated by an Individual

MyMindSeed is an independent project run by a single individual (Section 1). Support and response times may therefore be limited. We reply as quickly as we can, usually within a few days.

2b. Changes to the Service

We keep developing MyMindSeed. We only change features for a valid reason, for example new legal requirements, security, technical developments, a third-party provider changing or discontinuing its service, or to offer new features. This causes no additional costs for you.

If a change affects your access or use more than insignificantly, we will inform you by e-mail in advance – with the characteristics and timing of the change and your right to terminate free of charge within 30 days because of it. If you terminate for this reason, we refund the value of purchased tokens you have not yet used on a pro-rata basis. Your statutory rights (Section 327r German Civil Code) remain unaffected.

3. Registration and Contract Formation

3.1 Account
Using MyMindSeed requires an account. You enter your e-mail address and a password, confirm these Terms and the consents and click “Register”. This is your offer to conclude a free user agreement. The contract is formed when you confirm your e-mail address via the link in our e-mail. Please keep your e-mail address up to date – we send important notices such as a termination there.

3.2 Minimum Age
Use of the platform is only permitted for persons aged 18 or older. By registering, you confirm that you are at least 18 years old.

3.3 Login Details
Keep your login details secret. You are liable for actions of others under your account to the extent you are responsible for them – for example because you shared your password.

3a. Purchases, Prices, Contract Language and Contract Text

3a.1 How to Buy
On the tokens page you choose a token pack or the monthly subscription, confirm the notice on the right of withdrawal (Section 7.3) and are taken to our payment provider Stripe. There you see the price and payment method, can check and correct your entries or cancel the purchase. You only buy bindingly when you click the payment button at Stripe (Section 7.2).

3a.2 Prices
The prices shown on the tokens page at the time of purchase apply. All prices are final prices. As a small business under Section 19 of the German VAT Act (UStG), we do not charge VAT.

3a.3 Contract Language and Contract Text
You can conclude contracts in German or English. You can view, save and print these Terms here at any time. We send you the details of every purchase by e-mail; beyond that, the contract text is not available to you from us.

4. Token System

4.1 What Tokens Are For
You pay for paid features with tokens. Current prices are shown on the tokens page; at present:

• Chat reply: 3–5 tokens depending on the Mindseed's rank, 6 tokens more with voice output
• Creating or changing an entry in memories, biography or traits: 10 tokens
• AI image: 5 tokens
• Cloning a voice: 80 tokens

4.2 How You Get Tokens

• Buying a token pack or the monthly subscription (Sections 7 and 7a)
• One-time welcome bonus at registration (50 tokens)
• Daily bonus to claim (10 tokens)
• A share when others chat with your shared Mindseed (from certain ranks)

4.3 No Cash Value, No Expiry
Tokens cannot be exchanged for money, paid out or transferred. Purchased tokens do not expire as long as your account exists.

4.4 Spent Tokens
We do not refund tokens already spent. If a feature fails for technical reasons, we either do not charge for it or credit the tokens back automatically. For the right of withdrawal, see Section 7.

5. Your Content and Rules

5.1 Your Content
You keep all rights to your content (texts, photos, videos, voice recordings). You only grant us the right to store and process it as far as MyMindSeed needs to: for your Mindseed, for transfer to our technical service providers and – if you share your Mindseed – so that it talks to others within the visibility you chose and shows the media you shared. This right ends when you delete the content.

5.2 What Is Not Allowed

• Illegal, insulting, hateful or defamatory content
• Content glorifying violence, pornographic content, any sexualisation of minors
• Spam, advertising or commercial content (without our permission)
• Content that infringes the rights of others, such as copyright or personality rights
• Content that exposes other people or reveals their private details without need – tell others' stories with consideration, especially in a shared Mindseed
• Mindseeds, photos or voices of other real people without their consent (e.g. replicas of celebrities, acquaintances or ex-partners) – your own Mindseed with your own photos and voice is expressly allowed, as are people who have consented
• Abuse of the platform, such as fraud, harassment via bridge messages or instructions to a shared Mindseed intended to deceive or harm visitors
• Technical manipulation or circumventing protective measures

5.3 Bridge Messages

• Only people whose Mindseed is shared (public or via link) can receive messages. Receiving is on at first; you can turn it off at any time under “Messages”.
• To send a message you do not have to turn on receiving yourself. The recipient sees your display name as the sender.
• At most 3 messages per 24 hours per Mindseed, at most 500 characters per message and reply.
• Replying to a message costs no tokens. The reply appears in the sender's outbox, and the Mindseed passes it on to them in their next conversation.
• Via “⋯” next to a message you can block the person or report the message. After a block, you can no longer write to each other or talk to each other's Mindseed; the person is not notified. You can lift the block in the message settings.

5.4 How We Check Content

• Checked automatically: uploaded photos and videos, image requests, bridge messages and replies, the name and short description of a Mindseed, display names and – once a Mindseed is shared – its long description, memories, traits and biography. We use AI checks by OpenAI for this. We do not check the content of private Mindseeds or your chats in this way.
• If the check rejects something, it is not saved or not sent; you see the reason straight away.
• Only one restriction applies automatically: after 10 rejected bridge texts within 24 hours you cannot send or answer bridge messages for 24 hours, and for 7 days if blocked again within 30 days.
• Everything else is decided by a person: for serious reasons, accumulated rejections or reports (Section 5.5). Possible measures are a warning, a temporary block of uploads or bridge messages, setting a Mindseed back to private, removing content, or blocking or terminating the account (Section 8.2). We choose the mildest measure that is sufficient.
• We inform you of every measure by e-mail, with the reasons. If you think a rejection or measure is wrong, reply to that e-mail or write to us via the contact form; a person will review it again.

5.5 Reports
Anyone can report content that breaks the law or these Terms via “Report content” (link at the bottom of every page and on every shared Mindseed), even without an account. Bridge messages and replies are reported directly in your messages via “⋯” next to the message. A person reviews every report. The reporting person is told what we decided.

5.6 Note on AI
Your Mindseed is an AI. Anyone chatting with it sees a notice that they are talking to an AI. Replies, images and cloned voices are AI-generated. Do not pass them off as genuine statements or recordings of a person.

5a. AI-Generated Content

This applies in particular to shared Mindseeds: when others chat with your Mindseed, it may give an inaccurate or false impression of you. Please review your Mindseed regularly and correct memories, biography and traits where needed.

5b. Profile Photo and Media

You can upload a profile photo as well as photos and videos for your Mindseed. If your Mindseed is shared, others also see the profile photo and the media you released. Only upload content you hold the necessary rights to and where the people shown agree. If you do not want others to see anything, set your Mindseed to “private”.

6. Liability

6.1 Scope
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence we are only liable if we breach an essential contractual obligation – an obligation whose fulfilment makes the contract possible in the first place and on which you may rely. In that case liability is limited to the damage typical for the contract and foreseeable. Otherwise, liability for slight negligence is excluded. Your statutory rights in the event of defects in digital products (Sections 327 et seq. German Civil Code) remain unaffected.

6.2 AI Responses
We do not promise that replies, images or other AI content are correct, complete or suitable (Section 5a). Do not rely on them for important decisions.

6.3 Cloned Voices
How good a cloned voice sounds depends on your recording and the technology (MiniMax). Differences from the original voice are not a defect; tokens are therefore not refunded.

6.4 Availability
MyMindSeed uses services from third-party providers. Maintenance, technical faults or changes to these services may lead to outages. We are only liable for this under Section 6.1.

7. Payments and Right of Withdrawal

7.1 Payment Processing
Payments are processed by the payment service provider Stripe (Stripe Payments Europe, Ltd., Ireland); credit card and PayPal are available. Your contractual partner remains MyMindSeed (Section 1). The terms of the chosen payment method additionally apply to the payment itself.

7.2 Conclusion of the Contract When Buying
The contract is concluded when you complete the payment at Stripe (Section 3a.1). Afterwards you receive a confirmation by e-mail.

7.3 Early Expiry of the Right of Withdrawal
Tokens are digital content not supplied on a tangible medium. The right of withdrawal expires as soon as we have begun performing the contract after you (1) expressly agreed that we begin performance before the end of the withdrawal period, (2) acknowledged that you thereby lose your right of withdrawal once performance begins, and (3) we confirmed the contract to you on a durable medium (e-mail) (Section 356(5) German Civil Code). You give this consent on the tokens page before buying; performance begins when the tokens are credited immediately after payment.

7a. Monthly Subscription

7a.1 Service and Price
The monthly subscription costs €9.99 per month. At the start of each billing month, 500 tokens are credited after successful payment. Subscription tokens do not expire and stay on your account after the subscription ends.

7a.2 Term and Renewal
The subscription starts when you take it out and runs for one month at a time. It renews automatically for another month unless cancelled beforehand. The amount is charged at the start of each month using the payment method chosen when subscribing.

7a.3 Cancellation
You can cancel the subscription at any time without notice with effect from the end of the current billing month: via “Cancel contracts here” (link at the bottom of every page, no login needed), on the tokens page, or by e-mail to info@mymindseed.com. You receive a confirmation by e-mail. The subscription continues until the end of the month; nothing is charged afterwards. The right to extraordinary termination for good cause remains unaffected.

7a.4 Deleting Your Account
If you delete your account, a running subscription ends immediately and nothing more is charged. There is no pro-rata refund for the current month, as its tokens have already been credited.

7a.5 Price Changes
A price change applies to a running subscription only if you expressly agree to it. If you do not agree, either side may cancel the subscription at the end of the billing month.

8. Termination of the User Agreement

8.1 By You
You can terminate the user agreement at any time by deleting your account (under “Home” in the account settings). Termination takes effect immediately.

8.2 By Us
We can terminate the user agreement by e-mail with four weeks' notice. In the case of serious or repeated breaches of these Terms we can terminate without notice for good cause; we will give you a warning first where this is reasonable. We terminate accounts that have not been used for 24 months in accordance with the first sentence; if you use your account within the four weeks, for example by signing in, it remains. This does not apply to accounts with a Mindseed shared publicly or via a link (Section 8a) or to accounts in which tokens were purchased or a subscription was taken out.

8.3 Consequences
When the agreement ends, we delete your data (see Privacy Policy). Download anything you want to keep beforehand (data export). Unused tokens expire with the deletion; we point this out before deletion. If we terminate without good cause (8.2 first sentence), we refund the value of purchased, unused tokens on a pro-rata basis. A running subscription ends immediately (Section 7a.4).

8a. Death of a User

If a user dies, the user agreement passes to their heirs. Heirs – or people holding a power of attorney valid beyond death – can contact us via the contact form or by e-mail. We need a death certificate and proof of entitlement (e.g. certificate of inheritance, an opened notarial will or the power of attorney).

• On request we hand the account's data export to the heirs, set a shared Mindseed to private, leave it shared so that family and friends can keep reading and hearing its stories, or delete the account.
• We end a running subscription. Tokens are not paid out (Section 4.3).
• We do not hand out passwords; logging in as the deceased person is not intended.
• As long as no death has been reported to us, everything stays as the person set it up.

Our tip: record in your own arrangements what should happen to your Mindseed – for example in a will or a power of attorney valid beyond death.

9. Changes to the Terms of Service

We may amend these Terms of Service for the future, for example when features, prices or legal requirements change. We will inform you of changes by e-mail in good time beforehand. The amended Terms apply to you only once you expressly agree to them. Until then the previous Terms continue to apply; if you do not agree, either side may terminate the user agreement under Section 8.

10. Final Provisions

10.1 Applicable Law
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in another country, you keep the protection of the mandatory provisions of that country.

10.2 Place of Jurisdiction
The place of jurisdiction is Augsburg, Germany, insofar as you are a merchant, a legal entity under public law or a special fund under public law.

10.3 Dispute Resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If there is a problem, please write to us directly.

10.4 Severability
Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.

This English version is a translation for your convenience. If you concluded your contract in German, the German version applies.
